Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Providr platform, website and related services, provided by Providr Pty Ltd ("Providr", "we", "us" or "our"). By using Providr, or by signing an order or agreement that refers to these Terms, you agree to them.

1. About Providr

Providr is a care management platform built for NDIS providers. It brings rostering, timesheets, payroll, NDIS claiming, invoicing, compliance and a worker mobile app into one connected system, built for NDIS and made in Australia.

2. Your account

To use Providr you must be an NDIS provider, or be authorised to act for one, and provide accurate account details. You are responsible for your account, for keeping login details secure, and for everything done under your account by your team.

3. Getting set up

Providr includes a one-time onboarding and setup. As part of this, we help migrate your existing data, such as participants, workers and rosters, so you start on real data rather than a blank screen. You are responsible for making sure the data you provide is accurate and that you have the right to share it with us.

4. Fees and payment

Our pricing has two parts:

Fees are in Australian dollars and exclusive of GST unless stated otherwise. We may change our pricing from time to time and will give you reasonable notice before a change affects your subscription.

5. Your responsibilities

You are responsible for using Providr lawfully and for meeting your own obligations as an NDIS provider, including under the NDIS Quality and Safeguards framework, the SCHADS Award and the NDIS price guide. Providr is a tool that helps you meet these obligations, but you remain responsible for your participants, your workers, your records and your compliance.

6. Acceptable use

You agree not to misuse the platform, attempt to access it without authorisation, interfere with its operation, reverse engineer it, or use it to store or send unlawful content.

7. Your data

You own the data you put into Providr. You grant us the rights we need to host, process and back up that data so we can provide the service. We handle personal information in line with our Privacy Policy. You can export your data, and on request after your account ends we will make your data available for a reasonable period before secure deletion.

8. Our intellectual property

We own the Providr platform, software, design and brand. These Terms do not give you any ownership of the platform, only the right to use it while your subscription is active.

9. Confidentiality

Each party will keep the other's confidential information confidential and use it only to provide or use the service.

10. Availability and support

We work hard to keep Providr available and supported by a local team. We do not guarantee the service will be uninterrupted or error free, and we may carry out maintenance from time to time.

11. Disclaimers

Providr is provided on an "as is" and "as available" basis. We do not provide legal, financial, clinical or compliance advice, and the platform is not a substitute for your own professional judgement or for meeting your obligations as an NDIS provider.

12. Liability

To the extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, our liability to you for any claim connected with the service is limited, and we are not liable for indirect or consequential loss.

13. Ending the agreement

You can stop using Providr and end your subscription in line with your plan. We may suspend or end access if these Terms are seriously or repeatedly breached. When the agreement ends, your right to use the platform stops, and the data export terms above apply.

14. Changes

We may update these Terms or the platform from time to time. If we make a material change to these Terms, we will let you know. Continuing to use Providr after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Australia and the state in which Providr Pty Ltd is registered, and the courts of that state have jurisdiction.
